+ May I consume cannabis on Caliva's property?
Unfortunately, no. Due to San Jose laws, Medical Marijuana may not be inhaled, smoked, eaten, ingested, vaped, or otherwise used or consumed at the Premises and/or Location, in the parking areas of the Premises and/or Location, within 300 feet of the Premises and/or Location on the public right of way, or in those areas restricted under the provisions of California Health and Safety (Code Section 11362.79.)
+ Can I give cannabis to someone else as a gift?
Absolutely! Share the wealth, but only with those 21 years or older. Just an FYI - you may not carry more than one ounce of marijuana or 8 grams of concentrated cannabis on you at one time.
+ Can I have or carry cannabis in my car?
Yes, cannabis may be carried in cars but it may not be in an open container and cannot cross state boundaries. It is illegal to use or consume marijuana in a motor vehicle and it is illegal to drive under the influence of marijuana.
+ Can I take it on a plane?
Flying with cannabis on any commercial flight—domestic or international—is illegal, and that remains true even if you are a medical marijuana patient. All airports, airplanes, and air spaces are under the jurisdiction of federal law, and since cannabis is still federally illegal that means traveling with cannabis risks being arrested and prosecuted. The Transportation Security Administration (TSA) says that they won’t search people for marijuana specifically although if they do discover it during routine screenings, legal actions will be taken. Since the TSA is an agency of the federal government, marijuana is still considered illegal.
